NEW JERSEY · REFERENCE BRIEF

Time records are a client responsibility, too.

Make the weekly information exchange between the worksite and the staffing agency explicit.

The starting point

New Jersey’s TWBR rules require third-party clients to keep and remit specified assignment and time information for covered placements. The statute sets a seven-day deadline after the last day of the worked week for specified information. A client’s failure to send information does not excuse the agency’s recordkeeping obligations.

For the staffing agency

Reconcile received records and follow up on missing information.

For the employer / client

Assign an owner for accurate time records and timely transmission.

Suggested operational next steps

  1. Agree a recurring submission deadline.
  2. Create an escalation path for missing records.
  3. Review one complete week for a covered assignment.
