#law

Where can I read the TWBR law and implementing rules?

Read P.L. 2023, c.10 and NJDOL’s statute-and-rule reference. The statute and regulations, together with relevant court decisions, govern application; this toolkit is a starting point.

02
#covered-work

Does the assignment fall in a covered classification?

Coverage depends on the designated occupational groups and actual duties. A job title or the client’s industry alone is insufficient. Use the state’s list and obtain an assignment-specific review when unclear.

This page does not classify an individual assignment or issue an exemption determination.
03
#assignment-notice

Which assignment notice should the staffing firm provide?

NJDOL identifies MW-23 as the approved assignment notification. Use the state’s form and appropriate language version, rather than a self-designed substitute. Review the notice timing and change requirements with the official guidance.

The bilingual PDF currently linked by NJDOL is dated May 2023 and mentions a future update. Confirm the current approved revision with NJDOL before operational use; the link is not a certification of form currency.
04
#changes

What if the schedule, shift, or worksite changes?

For covered multi-day assignments, the statute requires 48 hours’ notice of a schedule, shift, or location change when possible. Other changes to listed assignment terms also require attention. Agree a client-to-agency reporting process.

06
#earnings

What earnings information should the worker receive?

The staffing firm must provide the required itemized earnings information with each wage payment. NJDOL permits the information on the paystub or its MW-24 form. Review the complete required fields.

07
#registration

How do I check my staffing partner’s registration and TWBR certification?

Use the exact legal entity and any DBA. Check the applicable firm license or registration and, separately, Certification to Make Designated Classification Placements when relevant. Record status, numbers, and dates. A missing or ambiguous search result needs confirmation with DCA.

We do not run a live license check or endorse an agency. A registration result alone does not establish that an assignment or business is fully compliant.

Want to review the way the process works?

An operational review can help identify missing handoffs, documents and questions to raise with your staffing partner or attorney. It does not certify legal compliance.
